A court has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.

The situation originates in a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to face alien smuggling charges, he was detained in federal detention.

In her order, the judge noted that the government lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."
